Los Gatos Man Charged With 4th DUI

Punishment for felony drunken driving, with three prior similar offenses in less than 10 years, is 180 days, or six months in jail.

 

A Los Gatos man was arrested in Saratoga for his fourth DUI in less than 10 years the afternoon of April 13 by Santa Clara County sheriff's deputies.

Jon Costedoat, 48, was taken into custody at about 1 p.m. at 20236 Kirkmont Drive in Saratoga, according to a sheriff's report.

He was charged with driving under the influence of alcohol and a separate felony charge for his fourth DUI within 10 years of three other drunken-driving arrests.

If convicted, Costedoat will automatically be imprisoned in Santa Clara County Jail for a minimum of 180 days, or six months.

His bail amount was set at $150,000, according to the report. It's not known at this time whether he posted bail or remains in custody.

His privilege to operate a motor vehicle could also be revoked by the Department of Motor Vehicles and he could be asked to surrender his driver's license to the court.

Also, if found guilty, Costedoat will be designated as a habitual traffic offender for a period of three years, according to the law.

According to criminal defense attorney and legal analyst Steven Clark, four DUIs within 10 years is a felony with a maximum penalty of three years in jail.
