Los Gatos Man Arrested on Suspicion of Marijuana Cultivation

Arrest occurred the evening of April 19, suspect was booked and released from jail on a bail bond and will appear in court Thursday to answer to the charges.

Los Gatos resident Anthony Avelar, 31, was arrested on April 19 on suspicion of cultivation of marijuana at his residence in the unincorporated part of town.

According to Santa Clara County Sheriff's arrest reports, Avelar was arrested at 11:15 p.m. at 21390 Aldercroft Heights Road up in the Los Gatos Mountains.

Avelar was booked into Santa Clara County Jail on a $10,000 bail and was charged with felony cultivation of pot, which is a violation of the California Health and Safety Code.

Santa Clara County Sheriff's spokesman Jose Cardoza said Wednesday that Avelar was released from custody on April 20 on a bail bond and that his next court date is May 3 at the Santa Clara County Superior Court Hall of Justice, 190 W. Hedding St. in San Jose.

California Health and Safety Code 11358 makes cultivation of any marijuana plant a felony crime, punishable by up to three years in state prison and a $10,000 fine.

The law also prohibits all acts associated with growing and manufacturing pot, including handling of marijuana seeds, cultivation in soil, and then drying and processing of the marijuana once it's been harvested.
